A lawyer for hacker Khorokhorin, accused of embezzling $9.5 million, is asking a U.S. court to dismiss his case.

The defense of Vladislav Khorokhorin, a Russian-born hacker arrested in France, has sent a petition to a federal court in Washington, D.C., asking it to close their client’s case for lack of evidence, Lawyer Bukh said.

A petition requesting the evidence that prompted the arrest was also sent to the prosecutor’s office.

“We insist on dropping the charges and releasing Khorokhorin. We have requested evidence from the US government on his case, which we assume does not exist. Refusal to provide evidence will be an additional reason to close the case,” Bukh said.

Khorokhorin, according to the U.S. side, has citizenship of Ukraine and Israel and is accused of involvement in the embezzlement of about $9.5 million from bank accounts around the world, including the illegal cashing of funds in Moscow. He is involved in two cases in the United States: one in federal court in the District of Columbia, the other in the District of Georgia.

The hacker, who considers himself a Muscovite, was detained in August 2010 on an Interpol warrant in France for extradition to the United States. Khorokhorin’s extradition is currently being considered in the last instance, by the local city council of Marseille.
