An INTERPOL Red Notice can affect border encounters, detention risk and decisions about international travel. If you believe information about you is circulating through INTERPOL, obtain advice on the notice and the underlying national case. Arkady Bukh Law Firm assists clients seeking a coordinated legal response to international criminal allegations and related INTERPOL issues.
A Red Notice is a request to locate and provisionally arrest a person pending extradition or similar action. It is not an international arrest warrant. Each country decides what legal effect to give it. That distinction matters when evaluating what a successful INTERPOL challenge can accomplish.
Establish what information exists
The public INTERPOL website does not contain every Red Notice. An unsuccessful name search cannot establish that there is no law enforcement alert. Other forms of information sharing, including diffusions, may also require attention.
The Commission for the Control of INTERPOL’s Files, known as the CCF, handles requests concerning access to, correction of and deletion of personal data in INTERPOL’s system. Its procedures should be followed carefully. Since March 26, 2026, the dedicated online portal has been the standard channel for new requests, subject to the CCF’s stated exception for exceptional circumstances.
Before filing, counsel should identify the client’s objective and the available evidence. A request for access and a request for deletion ask different questions and need an appropriate supporting record.
Identify a ground within INTERPOL rules
A challenge should address compliance with INTERPOL’s rules. Potential issues can involve inaccurate information, the status of the underlying proceedings or restrictions on using INTERPOL channels for matters of a prohibited character. Article 3 of the Constitution prohibits activities of a political, military, religious or racial character.
The legal argument must be supported by facts. A political motivation claim needs more than a description of tense relations between countries. A claim that a commercial dispute was criminalized should examine the actual allegations and documents. Counsel should show how the evidence relates to the applicable rule.
A foreign dismissal, acquittal or other development can be important, but its exact scope matters. A decision concerning one proceeding may not resolve a different case or national warrant.
Prepare a clear CCF submission
A useful record can include identity documents, the relevant arrest or charging materials, court decisions, procedural history and evidence supporting the requested correction or deletion. Material documents may require translations.
We help clients organize the chronology, identify inconsistencies and focus the submission on issues the CCF can decide. Excessive background can obscure the central point. A concise explanation supported by a well-organized record is generally more useful than a collection of unconnected allegations.
Where there is an urgent concern, counsel can assess whether the procedures provide an appropriate request for interim treatment. Filing alone does not establish protection from arrest.
Coordinate the notice challenge with the national case
The CCF does not decide criminal guilt or replace national extradition courts. Deletion of INTERPOL data does not itself dismiss an indictment, cancel a domestic warrant or resolve a separate national database entry.
A client may therefore need several coordinated workstreams: the INTERPOL submission, defense of the underlying charges and local advice in a country where detention or extradition is possible. Each lawyer should understand the legal effect of the documents obtained in the other proceedings.
Questions about Red Notice removal
Can I travel while a CCF request is pending
A pending request is not travel clearance. Arrest risk depends on national law, active warrants and information available to local authorities. Obtain country-specific advice before making a decision.
Will the CCF hear my criminal defense in person
The CCF generally considers written submissions and documentation. Its role concerns INTERPOL data processing. Arguments that belong in the underlying criminal court should be developed in the appropriate national proceeding.
Discuss an INTERPOL response
Email info@arkadybukhlawfirm.com with the requesting country, known case reference and a brief description of any court developments. If someone is detained, identify the country and next hearing date. Arkady Bukh Law Firm can discuss the available U.S. and international coordination work following a conflict check.
